1. ACCEPTANCE OF TERMS & CONDITIONS
www.SouthWilts.com is provided by the South Wiltshire Community Web (SWSA) - a partnership of local public, private and voluntary sector organisations working together to improve the social, economic and environmental wellbeing of people living and working in South Wiltshire,
UK. SWSA provides its service to you, subject to the following Terms and
Conditions ("TOC"). The TOC may be updated by us from time to time
without notice to you, although we will do our best to let you know about
changes through the news section of the site. You can review the most
up-to-date version of the TOC at any time at: www.SouthWilts.com/admin/toc

2. DEFINITIONS
The following definitions are used in these terms and conditions and elsewhere on the SWSA Community Web

TOC These terms and conditions

SWSA Community Web The computer programmes, codes, databases and
facilities set up by the South Wiltshire Community Web and Cravenplan Computers Ltd to enable organisations, groups, businesses and individuals to build and maintain their own websites

www.SouthWilts.com The internet address or domain name for the SWSA
Community Web.

Trusted User : A user who has agreed to be bound by the TOC set out
hereunder and who has been issued with a User ID and Password by the Site
Administrators

Community Partner : A 'not-for-profit' organisation, group, club, society or other body providing services or facilities that are deemed to promote the social, economic or environmental wellbeing of South Wiltshire.

Commercial Partner : A business or commercial enterprise providing goods
or services within South Wiltshire

Commercial Tariff : Charges that may be applied to commercial partners.

Personal Subscriber : An individual Trusted User using ther facility for their own non-commercial purposes.

Website : Any pages, text, images or other information submitted by the Trusted User for inclusion on www.SouthWilts.com

SWSA : The South Wiltshire Community Web

Cravenplan : Cravenplan Computers Ltd

Administrator Admin Team : means any person or persons appointed by the
South Wiltshire Stratgeic Alliance to control the application of the TOC and administer the site

Upload : Enter, transmit or include any text, data or image to the pages you create within SWSA Community Web

Content : The text, data, images or other materials uploaded to to the pages you create within SWSA Community Web

3. OUR AIM
You understand and agree that the aim of SWSA Community Web is to encourage, promote and sustain the social, economic and environmental wellbeing of the inhabitants of South Wiltshire by creating a single point of access to a comprehensive range of local community information.
It a service that has been designed with the help of local people for the
benefit of local people.

4. OUR VALUES
You understand and accept that SWSA Community Web is underpinned by
the ethical and social values of equality, fairness, tolerance and impartiality. Furthermore, that it is an inclusive service that seeks to involve and engage all sections of the community regardless of race, ethnicity, creed, gender, age or sexual orientation. You are welcome to join in and participate but you fully undestand and agree that should you do anything that offends against the aim or values of SWSA Community Web then you will be excluded from the service and our online community.

5. THE SERVICE WE PROVIDE
SWSA Community Web provides its Trusted Users with access to a web page hosting service (the "Service"). Unless otherwise stated, any new features that augment or enhance the current Service shall be subject to the TOC.

6. SUBMISSION OF PERSONAL DETAILS
In return for using of the Service, you agree to provide true, accurate, complete and up-to-date information about yourself using the Service's application form and maintain and promptly update that information to keep it true, accurate, complete and up-to-date. If you fail to provide such information or provide any information that is untrue, inaccurate, not current or incomplete, or SWSA has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, SWSA has the right to refuse any and all current or future use of the Service. You also understand and agree that the service may include certain communications from SWSA, such as service and news announcements, administrative messages, surveys and consultations. The content, format and data contained within these communications are part of SWSA Community Web and are subject to the TOC. You will not be able to opt out of receiving them.

7. SWSA DATA PROTECTION POLICY
In accordance with the Data Protection Act 1998 you are notified that the personal information you have provided to SWSA will be held on computer and may be used for purposes that are pursuant to the powers and duties of the agencies that comprise the SWSA - for more information about the Alliance members visit www.SouthWilts.com/SWSA/members.htm. The SWSA
will not disclose this information to any third party without your consent. You agree that SWSA may notify you from time to time of services and goods offered by third parties in cases where the SWSA believes this may contribute to the promotion of the social, economic and environmental wellbeing of the area. You understand and agree that SWSA may use your Personal Data in order to carry out surveys, questionnaires or consultations to support the work of the SWSA and its partners.

8. YOUR CONDUCT
You understand that all data, text, images or other materials ("Content"), whether publicly posted or privately transmitted, are the sole responsibility of the person from which such Content originated. This means that you, and not SWSA, are entirely liable for all Content that you upload, post or otherwise transmit via the Service. SWSA does not control the Content posted via the Service and, as such, does not guarantee the accuracy, legality or quality of such Content. Nor does SWSA endorse, approve or otherwise accept the validity of the Content submitted to the Web Site

You understand and agree the SWSA Community Web is maintained on behalf of the wider community and that it must be regulated in a way that will protect the integrity of the service and avoid offence or upset to any person or group within South Wiltshire. In accordance with the spririt of the Site you agree to not use the Service to:

(a) upload any Content that is unlawful, harmful, threatening, abusive, defamatory, obscene, libelous or racially, ethnically or otherwise objectionable;
(b) upload any Content that may be harmful to children in any way;
(c) impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity;
(d) upload any Content that you do not have a right to transmit under
any law or under contractual or financial relationships;
(e) upload, post or otherwise transmit any Content that infringes any
copyright, patent or trademark;
(f) use the diary or news facilities to post unsolicited or unauthorized
advertising, promotional materials, "junk mail," "spam," "chain letters,"
"pyramid schemes," or any other form of information that may undermine the
reputation, credibility of functionality of the site in any way;
(g) to post multiple or duplicate copies of news releases or diary events in such a way that will affect in any way the credibility of functionality of the service
(h) upload any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;
(i) interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
(j) collect without their express permission personal data about other
users or visitors to your site;
(k) promote or provide information that may promote any illegal activities, promote physical harm or injury against any group or individual, or promote any act of cruelty to animals. This may include, but is not limited to, providing instructions on how to assemble bombs and providing instructions on how to cultivate, propagate or otherwise promote the use of drugs;
(l) have multiple SWSA Community Web addresses without prior permission
from SWSA; or
(m) engage in commercial activities without registering as a Commercial
Partners (for which charges may be applicable in accordance with the
Commercial Tariff) This includes, but is not limited to, the following activities:
* offering for sale any products or services;
* promoting services for which charges are, or may be applicable
* conducting raffles or contests that require any type of entry fee;
* displaying banners for services that provide cash or cash-equivalent
prizes to users in exchange for hyperlinks to their web sites.

9. CONTENT SUBMITTED TO SWSA COMMUNITY WEB
SWSA does not claim ownership of the Content you place on your SWSA Community Web Site. By submitting Content to SWSA for inclusion on your
SWSA Community Web Site, you grant SWSA the world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content for the purpose of displaying, distributing and promoting the SWSA
Community Web Site and in support of the SWSA Community Planning Process - for more information about community planning in South Wiltshire please see www.SouthWilts.com/SWSA/communityplanning.htm. This license exists only for as long as you continue to maintain web pages on the SWSA Community Web Site and shall be terminated 28 days after your web pages have been removed from SWSA Community Web Site.

SWSA Community Web is provided for the community. You acknowledge that users of the SWSA Communty Web have the right to object or complain about any content you include on your web pages and that the SWSA shall have the right in their sole discretion to refuse, remove or amend any Content that is available via the Service. Without limiting the foregoing, SWSA and its designees shall have the right to remove any Content that violates the TOC or is otherwise objectionable. You agree that you must evaluate, and bear all risks associated with, the use of any Content included on your web pages.

10. DATA PROTECTION - YOUR OBLIGATIONS
You agree to comply with the requirements of the Data Protection Acts 1984 and 1998 and other similar statutory provisions enforceable from time to time in other parts of the world.

11. LIMITS ON STORAGE

You acknowledge and agree that SWSA will limit the size of your personal file to 10MB of disk space. You also agree that SWSA will prohibit the uploading of image files over 50KB in size. You agree that should you wish to increase the amount of storage allocated for the storage of your Content the SWSA may make charges for this additional service.

12. SERVICE PROVISION
SWSA reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service with or without notice. You agree that SWSA shall not be liable to you or to any third party for any modification, suspension or discontinuance of the Service.

13. REMOVAL OF REDUNDANT PAGES
You agree to maintain your pages and keep them up to date. You further agree that SWSA may at its sole discretion and with or without notice, remove, modify or amend any site, page or content that has not been modified or updated for a period of 6 months or otherwise appears to be out of date.

14. TERMINATION
You agree that SWSA, in its sole discretion, may terminate your use of the Service and remove and discard any Content within the Service, for any reason, including, without limitation, for lack of use or if SWSA believes that you have violated or acted inconsistently with the letter or spirit of the TOC. SWSA may also in its sole discretion and at any time discontinue providing the Service with or without notice. You agree that any termination of your access to the Service under any provision of this TOC may be carried out without prior notice, and agree that SWSA may immediately delete your SWSA Community Web Site and all related Content and prohibit any further access to the Service. Further, you agree that SWSA shall not be liable to you or any third-party for any termination of your access to the Service.

15. ADVERTISEMENTS AND PROMOTIONS
SWSA controls all advertisements and promotions on SWSA Community Web Sites. By creating your SWSA Community Web Site, you agree that SWSA has the right to run such advertisements and promotions. Your business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the advertiser. You agree that SWSA shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

16. LINKS
SWSA, you or third parties may provide links to other World Wide Web sites or resources. Because SWSA has no control over such sites and resources, you acknowledge and agree that SWSA is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products, or other materials on or available from such sites or resources. You further acknowledge and agree that SWSA shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

17. SWSA PROPRIETARY RIGHTS

Except as authorised by SWSA, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Service or the Software, in whole or in part. SWSA grants you a personal, non-transferable and non-exclusive right and license to use the object code of its Software; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work of or otherwise attempt to discover any source code, sell, assign, sublicense, grant a security interest in or otherwise transfer any right in the Software. You agree not to modify the Software in any manner or form, or to use modified versions of the Software, including (without limitation) for the purpose of obtaining unauthorised access to the Service.

18. NOTICE
Notices to you may be made via either email or the postal mail service. The Service may also provide notices of changes to the TOC or other matters by displaying notices or links to notices to you generally on the Service.

19. GENERAL INFORMATION
The Alliance shall not be required to provide any services hereunder to the extent and for so long as it is prevented from doing so by any circumstances beyond its reasonable control (which shall include, without limitation, the unavailability of access to the internet, failure of third party software, systems, equipment or networks and failure of third party suppliers and subcontractors).

The SWSA reserves the right to assign its rights under these Conditions to a Charity or not-for-profit Company created expressly for the purpose of managing the services.

A Trusted User may not assign, charge, sub-licence, sub-contract or otherwise deal with all or any of its rights or obligations under these Conditions in whole or in part, without the prior written consent of The SWSA.

These Conditions will be governed by the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction over all matters arising pursuant hereto.

20. INDEMNITY
You agree to indemnify (and keep indemnified) The SWSA, its officers, agents, contractors, partners and Cravenplan Computers Ltd against any losses, expenses, damages and claims which it may incur as a result of the use of the facilities and services provided., your connection to the Service, your violation of the TOC, or your violation of any rights of another.

21. DISCLAIMER OF WARRANTIES
YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. SWSA DOES NOT GIVE
ANY WARRANTY AND MAKES NO REPRESENTATIONS ABOUT THE SERVICES PROVIDED HEREUNDER. IN PARTICULAR, WITHOUT LIMITATION, THE SWSA GIVES NO WARRANTIES AND MAKES NO REPRESENTATIONS RELATING TO THE AVAILABILITY OF THE www.SouthWilts.com WEBSITE OR THE USERS PAGES OR IN RESPECT OF ANY SECURITY BREACHES WHICH MAY OCCUR AT THE www.SouthWilts.com WEBSITE. ALL WARRANTIES, REPRESENTATIONS AND TERMS WHICH MAY OTHERWISE HAVE BEEN IMPLIED INTO THIS AGREEMENT BY LAW OR OTHERWISE ARE HEREBY EXPRESSLY EXCLUDED TO THE FULLEST EXTENT PERMITTED BY LAW.

THE SWSA SHALL NOT BE LIABLE TO THE USER IN ANY CIRCUMSTANCES FOR ANY ECONOMIC LOSS, INCLUDING LOSS OF PROFITS, BUSINESS, REVENUE, GOODWILL OR ANTICIPATED SAVINGS, HOWSOEVER ARISING AND WHETHER CLAIMED UNDER CONTRACT, TORT, NEGLIGENCE OR OTHERWISE AND WHETHER OR NOT SUCH LOSS IS REASONABLY FORESEEABLE OR MADE KNOWN BY THE TRUSTED USER TO THE SWSA.

FOR THE AVOIDANCE OF DOUBT, THE SWSA SHALL HAVE NO LIABILITY TO THE USER WHATSOEVER RESULTING FROM THE USER'S USE OR ATTEMPTED USE OF THE SITE OR THE SWSA SOFTWARE OR ANY SUCH USE BY THIRD PARTIES.
